Your usage of this site and placement of any order for any service or product indicate, you acknowledge that you have read and understood these Terms and Conditions.

2) Agreement to purchase

By entering into an agreement with any ANZ StudyConnect (A & NZ CONNECT) representative, consultant, contractor, employee or director, you agree to purchase at the agreed price the services or products provided by this website and/or ANZ StudyConnect (A & NZ CONNECT) and that full consideration is required at the completion of installation or delivery by ANZ StudyConnect (A & NZ CONNECT) to you, your server, representative or web domain (website) You agree to pay all fees.

3) Representation of earnings or income derived from ANZ StudyConnect

ANZ StudyConnect (A & NZ CONNECT) make no guarantees, promises or indications of any success in securing study, income or success that may be derived by using our service or products, nor do we make any representations, promises or guarantees in the success in accessing, being accepted in, or successfully completing any courses at any School, College, TAFE, University or online or other educational institution. Any and all success in securing study at any institution are determined by local & international laws, personal promotion on your behalf and other factors outside of the control and influence of ANZStudyConnect or A & NZ Connect. ANZ StudyConnect (A & NZ CONNECT) cannot and does not make any claims as to your success in securing a place at any institution or in any course, and make no promises, estimates or guarantees as such.

4) Courses or Business Availability

ANZ StudyConnect (A& NZ CONNECT) cannot promise or guarantee any success in procuring study in either Australia or New Zealand. There are certain criteria which must be met to qualify for study in both these countries. ANZ StudyConnect strongly recommends any party purchasing any membership product, resource or any other product or service from ANZ StudyConnect contact the local Department of Immigration for Australia or New Zealand (or their own local Department of Immigration – or equivalent) prior to purchasing any product or service from the ANZ StudyConnect site (or any of its Affiliates) to determine whether they are able to procure study opportunities in either of these countries. ANZ StudyConnect (A & NZ Connect) cannot be held responsible for any Governmental restrictions on citizens of any country entering Australia or New Zealand for study or any other purpose and make no promises or guarantees in this regard.

5) Limitation of Liability

5.1 Any liability of ANZ StudyConnect (A & NZ CONNECT) or its associates, partners, Affiliates, consultants or related companies in connection with goods or services supplied to you will, subject to any non-excludable liability for breach of conditions or warranties implied by legislation and to the maximum extent permitted by law, at the election of ANZ StudyConnect (A & NZ CONNECT), be limited to:

5.1.1 In relation to goods, the replacement or repair of the goods, the supply of equivalent goods, the payment of the cost of replacing or repairing the goods or the payment of the cost of obtaining equivalent goods; and

5.1.2 In relation to services, the supplying of the services again or the payment of the cost of having the services supplied again.

6) Copyright

Copyright in the ANZ StudyConnect or related website is property of ANZ StudyConnect (A & NZ CONNECT). Material on this website also comprises copyright material, trademarks and registered trademarks which are the property of ANZ StudyConnect (A & NZ CONNECT) and third parties. This property may only be used for the purposes of browsing the ANZ StudyConnect (A & NZ CONNECT) website and acquiring goods and services of ANZ StudyConnect (A & NZ CONNECT).

7) Applicable Law

These Terms and Conditions are governed by the laws in force in Victoria, Australia and Worldwide and you irrevocably and unconditionally submit to the non-exclusive jurisdiction of the courts of Victoria, Australia and any courts, which may hear appeals from those courts.

8) Information Provided by You

If you purchase goods and services from ANZ StudyConnect (A & NZ CONNECT) we may require you to provide your name, address, email address, credit card number or other details (“customer information”). We may subsequently require further details to enable the processing of any orders that you make. You agree to provide ANZ StudyConnect (A & NZ CONNECT) with current, complete and accurate customer information when asked to do so by the website or an employee, consultant or contractor of ANZ StudyConnect (A & NZ CONNECT).

9) Product Information

9.1 Prices of goods and services and delivery and other charges displayed on the ANZ StudyConnect (A & NZ CONNECT) website are current at the time of display.

9.2 We take every reasonable care to ensure accuracy of all products listed. However, we do not accept liability for any errors in pricing and description. Pricing and stock availability is subject to change anytime without notice.

10) Placing and Accepting Orders

10.1 Orders will not be dispatched until payment in full has been received and ANZ StudyConnect (A & NZ CONNECT) is satisfied with the integrity of the order.

10.2 Without limiting the operation of any other Terms and Conditions herein, ANZ StudyConnect (A & NZ CONNECT) not responsible for any loss or damage caused by late delivery or cancellation of an order or a product.

10.3 Placement of an order by you constitutes an offer to enter into an agreement with us (“your offer”). We will email you an Order Confirmation for the sole purpose of confirming the details of your offer. Please note that our Order Confirmation does not constitute an acceptance of your offer or reflect the status of your order in any way.

11) Cancellation by us

We reserve the right not to provide goods or services, terminate membership accounts, remove or edit content or cancel orders (or part thereof) at our sole discretion at any time. Without limiting the operation of any other Terms and Conditions herein, we will not be held liable for loss or damage arising from the exercising of these rights.

12) Cancellation by You

Our agreement with you only comes into existence once we have both confirmed your order and your payment has been processed. Once we have accepted payment for an order, cancellation of the order is within our sole discretion. Orders that cannot be cancelled will be subject to our terms, conditions and policies relating to Returns and Exchanges. If you decide to cancel your order after payment has been made, the payment is not refundable, except as a goodwill measure at the sole discretion of ANZ StudyConnect (A & NZ CONNECT). ANZ StudyConnect (A & NZ CONNECT) reserves the right to pursue you via a debt recovery process and through the applicable courts for the balance of the agreed purchase cost of any goods or services provided. You also agree that any Legal, Recovery or Court costs will be applied to the debt for the outstanding amount and pursued accordingly if we choose to pursue the balance owing.

13) Delivery and Installation

13.1 It is your obligation to enter the correct delivery address details at time of ordering. If you enter the wrong address (either electronic or physical), we are not obliged to re-send the order to the correct address at our expense. We will provide you with an estimated date for delivery of all parcels or items and while we make every effort to deliver by this time, all dates specified are estimates only. Unfortunately, we are unable provide a guaranteed time of delivery.

13.2 It is the responsibility of the customer to inform ANZ StudyConnect (A & NZ CONNECT) if an order does not arrive. Once we learn an order has not arrived by the due date, we will lodge enquiries with the courier to ensure delivery occurs as soon as possible. We will not be held liable for any loss or damage resulting from late delivery.

13.3 Please note that if an item has been lost in transit, we may not dispatch a replacement item immediately. Replacement items will be dispatched according to our discretion. Without limiting the operation of any other Terms and Conditions herein, you agree that late delivery does not constitute a failure of our agreement, and does not entitle you to cancellation of an order.

13.4 Without limiting the operation of any other Terms and Conditions herein, we will not accept liability for any loss or damage arising from items lost, stolen or damaged after delivery has taken place.

14) Returns and Exchanges and Refunds

You or the recipient of an order may not return an item that has been purchased from ANZ StudyConnect (A & NZ CONNECT). Items include any physical, electronic product or Membership Product. Should you object to any of these Terms and Conditions (including any subsequent amendments), you must immediately cancel your order. Please refer to the paragraph on Delivery for clarification on cancelling an order.

15) Release and Indemnity

15.1 You agree to waive any and all claims that you now have or may have at any time in the future against ANZ StudyConnect (A & NZ CONNECT) or its Associates which relate to or are incidental to any transaction. You agree to indemnify and hold ANZ StudyConnect (A & NZ CONNECT) harmless from and against any and all claims, loss or expense that may be incurred by ANZ StudyConnect (A & NZ CONNECT) or its Associates which relate to or are incidental to the performance of its duties as described in these Terms and Conditions including all costs of defending itself against a claim by any other person and/or as a result of you taking any action or refraining from taking any action or instituting or defending any action or legal proceeding.

15.2 You further agree to indemnify and hold ANZ StudyConnect (A & NZ CONNECT) and its Associates, Partners, Businesses, Affiliates, Consultants, Contractors, Employees and any and all related entities harmless from any claim made by any third party due to or arising out of your use of this website or the products or services we offer, the violation of these Terms and Conditions by you, or the infringement by you, or other users of this website, of any intellectual property or other right of any person or entity.

15.3 You also agree that you and your partners, employees, Affiliates, consultants, contractors will utilize the service and products provided by ANZ StudyConnect (A & NZ CONNECT) in a legal and proper manner, abiding by all local, state, federal and international laws applicable. You agree to fully indemnify ANZ StudyConnect (A & NZ CONNECT) and all its associates, Affiliates, partners, related entities, employees, contractors, consultants and directors against any claim in any form arising from the use of this site, it’s services and products by you, your company and any related entity using the service provided by ANZ StudyConnect (A & NZ CONNECT) to you.

15.4 You agree to investigate and obtain all licenses, paperwork, legal documentation required to utilize this website and its services or products and take full personal responsibility to ensure compliance of all laws, codes and requirements governing education in your country, state or region and within Australia or New Zealand.

15.5 You also agree to accept that ANZ StudyConnect (A & NZ Connect), its partners, employees, Affiliates, consultants, and contractors do not, in any way guarantee success in finding study, or any other study-related, business or employment opportunities via this site. ANZ StudyConnect is a vehicle for connecting prospective students (you) with prospective courses available or educational institutions. The success or otherwise of any courses you may apply for are determined by a number of factors, including your interaction with the offering organization, government restrictions, amongst other factors. ANZ StudyConnect has no influence and does not make any promises of influence in assisting you to secure any such courses or placements in any School, College, TAFE, University or online institution.

16) Acceptance and Agreement

By making any purchase or taking delivery of any product, service or membership from ANZ StudyConnect (A & NZ CONNECT), you agree that you have read and agree to be bound by all the Terms and Conditions outlined on this page on behalf of yourself, your company and any entity, Affiliate, associate, partner, company or individual that you represent and also agree to fully and wholly indemnify ANZ StudyConnect (A & NZ Connect) along with its Partners, Directors, Employees, Affiliates, Consultants, and Contractors from any loss, damage or unsuccessful outcomes as a result of using this site or any of its services.
